1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Plate-wise ("Company," "we," "our," or "us") concerning your access to and use of the Plate-wise mobile application and related services (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18 years old, you must have parental or guardian consent to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Maintain the security of your password and account
Immediately notify us of any unauthorized use of your account
Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Service Description

Plate-wise provides:

4.1 Core Features

AI-powered food recognition and nutritional analysis from photos
Manual food and meal logging via text input
Calorie and macronutrient tracking (protein, carbs, fat)
Personalized nutrition recommendations via AI assistant (Sage)
Progress tracking, insights, and streak visualization
Cycle-aware nutrition for women (optional)
Meal planning assistance (Premium)
PDF export of nutrition reports (Premium)

4.2 Social Features

Tables: Social dining groups (2-8 members) for group meal tracking and accountability
Friends: Connect with other users via email or username search
Plate Party: Group meal photo capture with calorie splitting among participants
Streak Trees: Visual tree growth based on group or individual logging streaks
Push Notifications: Alerts for social activity, meal reminders, and streak milestones
Deep Links: One-click invite links for Tables and friend requests
Nudges: Send friendly reminders to Table members who haven't logged

4.3 Offline Capabilities

Offline meal capture with pending AI sync
Automatic data synchronization when connectivity is restored
Local storage of meal data for uninterrupted tracking

4.4 Availability

Plate-wise is available on the Google Play Store for Android devices and as a web application at plate-wise.com. Pro subscribers enjoy automatic cloud sync across all platforms, ensuring your progress is always up to date on any device.

5. Subscription Plans & Payments

5.1 Free Plan

3 AI food captures per day
7-day data retention (local storage only, single device)
1 AI meal plan per day
Basic calorie and macro tracking
Limited social features

5.2 Pro Plan ($9.99/month or $79.99/year)

30 AI food captures per day
12-month data retention with cloud sync across all devices
10 AI meal plans per day
Sage AI chat assistant (10 chats/day)

5.3 Referral Program

Share your unique referral code with friends

You earn $10 credit when they subscribe
Credits apply automatically to your next billing cycle

5.4 Payment Terms

Payments are processed securely (we never store your card details)
Subscriptions auto-renew unless cancelled
Cancel anytime in Settings > Subscription
No refunds for partial subscription periods
Price changes will be communicated in advance

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Harass, abuse, or harm other users
Impersonate another person or entity
Attempt to bypass rate limits or security measures
Upload malicious content, viruses, or harmful code
Scrape, crawl, or collect data without authorization
Resell, redistribute, or commercialize the Service
Reverse engineer or attempt to extract source code
Use automated systems to access the Service without permission
Spam other users or abuse notification features

7. User Content

You retain ownership of content you create (meal logs, photos, profile data). By using the Service, you grant us a limited license to use your content solely to:

Provide and improve the Service
Process AI analysis of your food photos
Generate personalized recommendations
Display information to users you've authorized (social features)

Food photos are processed temporarily for AI analysis and are not permanently stored. You are responsible for ensuring you have the right to upload any content.

8. Health Disclaimer

IMPORTANT: Plate-wise is NOT a medical device and does NOT provide medical advice.

AI nutritional estimates are approximations and may not be perfectly accurate
The Service is for informational and educational purposes only
Always consult healthcare professionals for medical nutrition advice
Do not use Plate-wise to diagnose, treat, or manage medical conditions
If you have eating disorders, consult a professional before using calorie tracking apps
Women's health features (cycle tracking) are informational only

By using the Service, you acknowledge that you use nutritional information at your own risk and that we are not responsible for health outcomes.

9. AI Features Terms

When using AI-powered features (food recognition, Sage assistant, meal planning):

AI results are estimates and may contain errors
You should verify nutritional information before making health decisions
AI recommendations do not constitute medical or nutritional advice
We use third-party AI services subject to their terms
AI features require internet connectivity
Daily usage limits apply based on your subscription tier:
- Free: 3 AI captures/day, 1 meal plan/day, no AI chat
- Pro: 30 AI captures/day, 10 meal plans/day, 10 AI chats/day
Abuse prevention limits may apply (excessive usage in short periods)

10. Social Features Terms

10.1 Tables

Tables require 2-8 members
Table creators can manage membership and settings
All members can view each other's meal logging activity within the Table
You may leave any Table at any time
Abuse of Table features (spam, harassment) may result in account suspension

10.2 Friends & Social Connections

Friend connections require mutual acceptance of requests
Privacy settings control what information friends can see (streak, calories)
You may remove friends or block users at any time
You are responsible for maintaining appropriate conduct in social interactions

10.3 Plate Party

Plate Party allows group meal photos with calorie splitting
All participants must consent to calorie allocation
Plate Parties expire after 24 hours if not completed
You are responsible for accurate participant selection

10.4 Push Notifications

Social notifications require device permission
You may disable notifications at any time in Settings
Notification frequency is managed to prevent spam
We store device tokens (FCM) solely for notification delivery

11. Intellectual Property

The Service, including all software, text, graphics, logos, and trademarks, is owned by Plate-wise or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including:

Merchantability, fitness for a particular purpose
Accuracy, reliability, or completeness of content
Uninterrupted or error-free operation
Security or freedom from viruses

AI nutritional estimates are approximations and may not be perfectly accurate. Results may vary.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLATE-WISE SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, or goodwill
Service interruptions or data loss
Errors in AI analysis or recommendations
Health outcomes or medical conditions
Third-party content or services

Our total liability shall not exceed the fees you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for:

Violation of these Terms
Fraudulent or illegal activity
Extended periods of inactivity
Technical or security reasons

Upon termination, your right to use the Service ceases immediately. You may delete your account at any time in Settings.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through appropriate legal channels.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
